Terms of service

Welcome to Kosmētikos Agora!

These general terms of sale and use (the “Terms”) apply to every visit to kosmetikosagora.com (the “Site”) and to every order placed by a consumer with Kosmētikos Agora. In this text, “we” means Kosmētikos Agora and “you” means the visitor or customer.

These Terms can be viewed at any time from the footer of the Site and from the checkout page, alongside our other policies. By confirming your order, you acknowledge that you have read and accept them. The applicable Terms are those in force on the date of your order. They are written in French, which prevails over any translation.

Article 1 – Who are we?

Kosmētikos Agora, SASU (single-shareholder simplified joint-stock company) with share capital of €100, registered office: 60 rue François 1er, 75008 Paris, France. RCS Paris 942 450 420 – SIRET 942 450 420 00016 – EU VAT number FR25942450420.

Customer service: contactmail@kosmetikosagora.com – +33 (0)7 67 09 32 27.

The Site is hosted by Shopify International Limited, Victoria Buildings, 2nd floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. Publication director: Miguel Rodriguez Amaro.

Article 2 – Access to the Site and customer account

To place an order, you must be of legal age and legally able to enter into a contract. A minor may only use the Site under the responsibility of their parents or legal guardians.

The information you provide (identity, email, addresses, payment) must be accurate and up to date. If you create an account, you are responsible for keeping your login details confidential; your account is personal and cannot be transferred.

Article 3 – Our products

Our products are cosmetic products that comply with Regulation (EC) No 1223/2009. Each product page states the product’s main characteristics, its full ingredient list (INCI), its directions for use and its precautions. Please read them before buying, especially if you have a known allergy.

We recommend testing any new product on a small area of skin (inside of the elbow) 24 to 48 hours before first use. If a reaction occurs, stop using it and seek advice from a healthcare professional. Our products are not medicines; the advice published on the Site does not replace medical advice. Store the products away from heat and light and observe the period after opening (PAO) shown on the packaging.

Photos are as faithful as possible, but colours may vary depending on your screen. Our products are offered while stocks last. We may limit quantities per order in order to serve as many customers as possible.

Article 4 – Orders

You fill your basket, check its content, the total price and the delivery costs, correct any errors and then confirm your order by clicking the “Order with obligation to pay” button (or equivalent). The contract is concluded when we receive your payment. We then send you a confirmation email with the details of the order and these Terms.

We may refuse or cancel an order only for a legitimate reason: payment refused, suspected fraud, abnormal quantities or an unresolved previous dispute. If a product turns out to be unavailable after your order, we will inform you and refund the corresponding amount within 14 days at the latest.

Our products are sold for personal use. Commercial resale is not permitted without prior agreement; professionals may contact us for a dedicated offer.

For any order of €120 or more, we keep the contract for 10 years and you may access it on simple request (Articles L213-1 and D213-1 of the French Consumer Code).

Article 5 – Prices and payment

Prices are shown in euros, including all taxes (VAT included), excluding delivery costs. Delivery costs are shown before you confirm your order. The price charged is the one in force at the time of the order.

When a price is reduced, the reference price shown is the lowest price applied during the 30 days before the reduction (Article L112-1-1 of the French Consumer Code).

On the Site, we accept: Carte Bancaire, Visa, Mastercard, American Express, Apple Pay, Shop Pay and PayPal. Payment is secure and charged when the order is confirmed; we never have access to your bank details.

For orders placed outside the Site (Click & Collect, orders by email), we also accept bank transfer and Wero. For in-person sales (events, fairs, hand delivery), we also accept cash and card payments via payment terminal (SumUp). Products are shipped or handed over after payment is received.

Article 6 – Delivery

Delivery areas, methods, rates and times are set out in our Shipping Policy and before you confirm your order. If no date is given, we deliver no later than 30 days after the order (Article L216-1).

In the event of a delay, you may ask us by email to deliver within a reasonable additional period; if delivery does not take place within that period, you may cancel the order and be refunded within 14 days (Articles L216-6 and L216-7).

The risk of loss or damage passes to you when you, or the person you have designated, take physical possession of the products (Article L216-4). If a parcel arrives damaged or incomplete, please write to us with photos as soon as possible so that we can help you and take action with the carrier.

Article 7 – Right of withdrawal

You have 14 days from receipt of the products to withdraw, without giving any reason (Article L221-18). To exercise this right, send us a clear statement (for example the form below) at contactmail@kosmetikosagora.com, via our Contact page or to our postal address.

Opened or used products. Our products do not have a safety seal: the right of withdrawal therefore applies to all our products, including after opening. However, you are liable for any loss in value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning (Article L221-23). You may examine the packaging and the bottle as you would in a shop; however, a cosmetic product that has been opened, applied or used can no longer be resold for hygiene reasons. In that case, the amount refunded is reduced by the loss in value found, which may amount to the full price of the product concerned (refund of €0 for that product). Products returned intact are refunded in full.

Returning the products. Send the products back no later than 14 days after informing us of your decision, following the instructions we give you. Return costs are paid by us.

Refund. We refund the amounts paid, including the original delivery costs (based on the standard delivery method), less any loss in value as provided above, no later than 14 days after being informed of your decision. We may withhold the refund until we receive the products or proof that they have been sent. In the event of a loss in value, we tell you the amount and the reason, with photos. The refund is made using the same payment method as the one used for the order, unless you agree otherwise.

More details in our Refund Policy.

Withdrawal form (complete and return only if you wish to withdraw from the contract):

To Kosmētikos Agora, 60 rue François 1er, 75008 Paris, France – contactmail@kosmetikosagora.com: I hereby give notice that I withdraw from my contract for the sale of the following goods: – Ordered on / received on: – Order number: – Name of consumer: – Address of consumer: – Signature of consumer (only if this form is notified on paper): – Date:

Article 8 – Legal guarantees

All our products benefit from the legal guarantee of conformity and the legal guarantee against hidden defects. To claim under them, contact us at contactmail@kosmetikosagora.com.

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer asks for the goods to be repaired but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement.

The consumer may obtain a reduction in the purchase price while keeping the goods, or end the contract and obtain a full refund in return for the goods, if: 1. the professional refuses to repair or replace the goods; 2. the repair or replacement takes place after a period of thirty days; 3. the repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or the costs of installing the repaired or replacement goods; 4. the lack of conformity persists despite the seller’s unsuccessful attempt to remedy it.

The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer is not required to first request repair or replacement of the goods.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The rights mentioned above result from Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs in bad faith the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for the goods.

Article 9 – Liability

We are responsible for the proper performance of your order, under the conditions provided by law. No clause of these Terms limits your statutory rights or our liability in the event of personal injury or fault on our part.

We cannot be held liable where a product is used in a way that does not follow its directions for use or precautions, or in the event of an act of a third party or force majeure. We make every effort to keep the Site accessible and free from errors, but cannot guarantee permanent availability (maintenance, technical incidents).

If you use the Site in breach of these Terms or of the law, you are liable for the damage you cause to Kosmētikos Agora or to third parties.

Article 10 – Display errors

Despite our care, an error may appear on the Site (description, availability, price). In the event of an obvious pricing error (a derisory price unrelated to the real value of the product), we may cancel the order concerned: we will inform you by email and refund you in full as soon as possible.

Article 11 – Customer reviews and content you publish

Anyone may post a review of our products, either via the personalised link sent by email after a purchase on the Site, or directly on the product page. The “Verified” label appears on reviews posted via this personalised link, which allows the review to be linked to a purchase made on the Site. The absence of this label only means that the purchase has not been verified in this way (for example, for a review left directly on the product page); it does not mean that the review was not written by a customer. Reviews are published automatically as soon as they are submitted and displayed in chronological order (newest first) with their date. We reserve the right to moderate them, at the time of publication or afterwards, in order to remove content that is unlawful, abusive, defamatory, off-topic, promotional or contains personal data. A review is never removed solely because it is negative; the author of a removed review is informed of the reason. Reviews, including those requested by email, do not give rise to any consideration (Articles L111-7-2 and D111-17 of the French Consumer Code).

By publishing a review, a photo or any other content, you guarantee that you are its author, that the content is sincere and that it does not infringe anyone’s rights. You authorise us to reproduce and distribute it free of charge on the Site, our social networks and our communication materials, worldwide, for 5 years, with your first name or username. You may ask us at any time to remove your content by writing to us. We may refuse or remove any content that is unlawful or contrary to these Terms.

Article 12 – Intellectual property

The brand, logo, product names, texts, photos, videos and design of the Site are the property of Kosmētikos Agora or its partners and are protected by the French Intellectual Property Code. Any reproduction or use without our prior written permission is prohibited, except for private use. Third-party trademarks mentioned on the Site (including Shopify) belong to their respective owners.

Article 13 – Use of the Site

You agree to use the Site fairly and lawfully. In particular, it is forbidden to: disrupt its operation or bypass its security features; introduce viruses or malicious code; extract its content by automated means (bots, scraping); collect other users’ data; impersonate another person; publish abusive, defamatory or unsolicited promotional content. In the event of a serious breach, we may suspend or delete your account, after informing you except in an emergency, without affecting orders already paid for.

Article 14 – Third-party tools and links

The Site may offer tools provided by third parties (payment, reviews, messaging, etc.) or links to other websites. These services are subject to their own terms; we do not control the content of third-party websites.

The Site is hosted and runs on the Shopify platform. However, sales are concluded directly between you and Kosmētikos Agora: Shopify is not a party to the sales contract.

Article 15 – Personal data

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (loi Informatique et Libertés), as described in our Privacy Policy. Some data is also processed by Shopify (Shopify privacy policy) and by our service providers, some of whom may be located outside the European Union with appropriate safeguards.

You have the rights of access, rectification, erasure, objection, restriction and portability, which you can exercise at contactmail@kosmetikosagora.com. You may also lodge a complaint with the CNIL (www.cnil.fr), the French data protection authority, and, if you have a French phone number, register free of charge on the Bloctel telemarketing opt-out list (www.bloctel.gouv.fr).

Article 16 – Changes to the Terms

We may change these Terms at any time; the version in force can always be viewed on this page. Each order remains governed by the Terms accepted at the time it was placed.

Article 17 – Miscellaneous

If a clause of these Terms is held to be void, the other clauses remain applicable. Failure to rely on a clause does not mean waiving the right to rely on it later. Where the meaning of a clause is in doubt, the interpretation most favourable to the consumer prevails (Article L211-1). We may transfer the contract to a third party (for example if the business is sold), provided that your rights are not reduced; you will be informed. Article headings are given for ease of reading.

Article 18 – Customer service, mediation and disputes

For any question or complaint, contact our customer service: contactmail@kosmetikosagora.com – +33 (0)7 67 09 32 27 – Contact page – 60 rue François 1er, 75008 Paris, France. We aim to reply within 48 business hours.

If your written complaint has not been resolved, you may refer the matter free of charge to the consumer mediator we are registered with, within one year of your written complaint to us (Articles L612-1 et seq.): Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C), 49 rue de Ponthieu, 75008 Paris, France – website: www.cm2c.net, where you can submit your complaint online.

These Terms are governed by French law. If you live in another European Union country, you keep the protection of the mandatory provisions of the law of your country of residence. Failing an amicable settlement, you may bring proceedings, at your choice, before the court of the place where you lived when the contract was concluded or when the harmful event occurred, or before any other court with jurisdiction under the law (Article R631-3).
